The Accra High Court made a decision on Friday, May 12th, to dismiss Dr. Kwabena Duffour’s injunction application against the National Democratic Congress (NDC)’s presidential and parliamentary primaries.
Dr. Duffour’s legal team requested the withdrawal of the case earlier in the day when it was called for hearing, and there was no objection from the NDC’s legal team or the Electoral Commission (EC).
His campaign team claimed that they had not received an accurate list of people who were supposed to participate in the May 13th Presidential and Parliamentary polls, and wanted the elections to be put on hold until an accurate list could be drawn up.
The NDC stated that they had already fixed most of the errors that Dr. Duffuor’s team had identified and urged the High Court to dismiss the application, calling it frivolous and incompetent, and not grounded in law.
NDC Takes Another Injunction
Meanwhile, Edgar Asamoah Boateng, a member of the National Democratic Congress (NDC), has taken legal action to stop the party from going ahead with its presidential and parliamentary primaries on May 13, 2023.
In his statement of claim, he stated that he was surprised that no voters’ register had been provided to his representatives or to other candidates, including those running for president. He claims that this has caused significant hostility within the party.
This comes after Dr. Kwabena Duffour’s injunction application against the NDC’s primaries was dismissed by an Accra High Court earlier in the day, following a request by his lawyers to withdraw the case.
Edgar’s lawyers are now seeking an order from the court to stop the primary elections until the matter is resolved, as well as any other orders that the court deems appropriate.
